MINUTES of the Meeting held in the Council Chamber, Swale House, East Street, Sittingbourne on Tuesday 4 September 2012 from 9:54 am to 10:16 am.

Present: Councillor Duncan Dewar-Whalley (Chairman), Ben Stokes and Mike Whiting.

Officers Present: Philippa Davies, Donna Price and Mark Radford.

221	election of chairman RESOLVED: (1) That Councillor Duncan Dewar-Whalley be elected Chairman for this meeting.
222	declarations of interest No interests were declared.
223	exclusion of the press and public RESOLVED: (1) That under Section 100A(4) of the Local Government Act 1972, the press and public be excluded from the meeting for the following item of business on the grounds that it involves the likely disclosure of exempt information as defined in Paragraph 1 of Part 1 of Schedule 12A of the Act.

224	review of complaint no. sbc 09.12 The Sub-Committee determined that, if proven, there may have been a potential breach of the following paragraph of the Code of Conduct: Paragraph 3(1) - you must treat others with respect. The Sub-Committee determined that on the information supplied by the complainant, there was no evidence to identify a potential breach of the Code of Conduct in respect of Paragraphs 3(2) and 5. RESOLVED: (1) That the complaint be referred to the Monitoring Officer for investigation in respect of Paragraph 3(1) of the Code of Conduct. (2) That no further action be taken on the complaint in respect of Paragraphs 3(2) and 5 of the Code of Conduct.
